3. Indemnification.

4. Third Party Rights.

The provisions of paragraphs 2 (Use of the Service), and 3 (Indemnification) are for the benefit of THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM and its owners, its officers, directors, employees, agents, licensers, suppliers, and any third party information providers to the Service. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

5.Term; Termination.

Either party may terminate this Agreement without notice at any time for any reason. Termination of agreement may affect your rights to access material in areas of the site that require a fee to participate in. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement. In the event you elect to cancel your membership for which you are paying a monthly fee or request a refund, you will not have rights to continue to access that area of the site. You are not buying a product in the membership areas of THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM. Your monthly fees (or whatever the payment frequency may be) are considered nothing more that rental fees to access the membership areas for thirty days from the date of your most recent payment in the example of a monthly payment plan. In the event you pay by another frequency method (such as one payment plan) and elect to cancel within thirty days of your initial purchase, you will be entitled to a refund and your access privileges will be terminated immediately. In the event you do not cancel, you will have access to the paid lesson area for a total of seven months from the date of purchase. After this seven month period, you may purchase additional access time in the members area for $7 per month on a month to month basis. Access will always expire at the end of thirty days (from the time you sign up for the extended month to month service) unless you are current with your monthly payment.

6.Miscellaneous.

This Agreement shall all be governed and construed in accordance with the laws of TENNESSEE applicable to agreements made and to be performed in TENNESSEE. You agree that any legal action or proceeding between THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM, ITS OWNERS, its officers, directors, employees, agents, and you for any purpose concerning this Agreement or the parties' obligations shall be brought exclusively in a federal or state court of competent jurisdiction sitting in TENNESSEE. Any disputes arising from the use of this site will be resolved first by mediation in the state of Tennessee and you fully assume all legal fees on your behalf. In the event said dispute can't be resolved by mediation, it is hereby agreed that the dispute shall be brought to court in the state of Tennessee. Any cause of action or claim you may have with respect to this site must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM may assign its rights and duties under this Agreement to any party at any time without notice to you.

7. Affiliate Marketers

THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM does allow individuals or businesses (often referred to as Affiliate Marketer) to refer guests to this site and in the event a referred guest becomes a paying customer, the referring business will often be paid a commission for said referral, subject to a customer canceling or not. THEGUITARTRIBE.COM AND/OR LEARNGUITARFASTANDEASY.COM shall in no way be responsible for claims, warranties, or guaranties made by any business or individual pertaining to this course or product. If you are an individual or business promoting anything about this site or the product itself, it is your sole responsibility to be and stay in compliance with any regulatory agency such as the F.T.C., the F.T.C Rules (that's a link), or anything similar.
